Terms of service

Last updated 29 September 2026.

These are the terms you agree to when you buy a migration from us. Current prices are on the main page; the price that binds is the one shown to you at checkout for your own job.

The short version

Who this agreement is between

These terms are between you (the person or organisation buying the service) and Minuscule Ventures, LLC, registered in the State of Delaware, trading as Embark. They start applying when you pay an invoice or tell us to begin work, whichever happens first. If you are agreeing on behalf of an organisation, you are telling us that you are allowed to.

What we do

We assess a WordPress migration and show you a preview. Catalog mappings are not guaranteed plugin equivalents: some renderers are unavailable, and preview rendering does not verify forms, payments, backups or imported settings. Hosting, moving your site and fees are covered below. Do not assume the preview is private.

The migration fee

Our current prices are published on the main page and shown to you again at checkout. Published prices are not an offer and may change at any time, without notice. What binds is the price shown to you at checkout for that purchase: once you have paid for a job, that job’s price is fixed, and nothing we publish afterwards changes it.

The size your site is quoted at (Small, Medium or Large site) comes from what our crawler measures on your site. If we cannot read your site, we do not quote — you get a plain message saying so, rather than a price derived from a failed reading.

What the conversion fee covers:

The fee does not include new design work, new features the old site never had, writing or restructuring your content, or work on systems we did not migrate. We quote those separately. We never add work to your bill without your agreement in writing first.

Payment is taken through Stripe, before the cutover.

The preview, and your go-ahead

We send you a preview link; do not assume it is private. Look around it, and send us the list of what is wrong; we fix it. Your live WordPress site is untouched the whole time.

The cutover — pointing your domain at the new site — happens only when you tell us to. We will not do it on our own initiative, on a schedule, or because a preview has been sitting unanswered.

If we hear nothing for 90 days after sending the preview, we may close the project, archive the work, and delete the copy on the schedule in the privacy policy. If that happens, the refund policy still applies: you had not accepted a cutover, so your migration fee comes back.

The care plan

Monthly hosting is optional and priced on the main page. It is billed monthly, never annually. Automated backup scheduling, retention and one-click restore are not part of it; if you need those, ask and we will arrange them separately in writing.

The AI Helper

The AI Helper comes with every hosting plan. It sits in your site’s admin. It reads your pages and posts to answer your questions about them, and it can propose changes to their text, titles and search-engine descriptions. Nothing it proposes reaches your live site until someone who edits your site approves it. The Helper can be wrong, so read what it proposes before you approve it.

It runs on Cloudflare Workers AI. Only when you ask it something do we send the model your question, the recent conversation, facts about your site (such as its name, its web addresses and its account’s email address), and the text of the pages and posts it looks at to answer you. Nothing is sent when nobody asks: opening the Helper sends nothing.

Each hosting plan includes a monthly allowance of Helper use, counted in what the model costs. The allowance for each plan is on the main page. When it is used up, the Helper stops answering until the next month begins; your site itself is not affected. Why an allowance: every answer costs real model time. The allowance keeps plans cheap for everyone and stops one site running up costs.

You can turn the Helper off. While it is off, the Helper sends nothing from your site to a model. Turning it off does not change your price. The Helper is not part of a site in your own Cloudflare account. Why: its allowance is paid for through our hosting plan.

Moving your site

A site can leave us once its conversion fee is paid. Why: the conversion is the work we do. Once it is paid, the site is yours to take anywhere.

Moving a site we host into your own Cloudflare account costs nothing more, and the conversion fee is never charged twice. When the move is done, we cancel your hosting plan and refund the unused part of that month. We keep our copy of your site for 30 days after the move, and then delete it. Why: so you have time to check that everything moved.

You can also run your site anywhere, via the full export: one download with your site’s database, its uploads, its settings, a WordPress export file and a short guide to running it on your own server.

What we need from you

Your content stays yours

You own your content and your data. You give us permission to copy, store, convert and serve it, for the sole purpose of providing the service you are paying for. Retention and deletion of any copies are described in the privacy policy; no automated backup retention schedule is promised here. We claim no ownership of your site, your words, your images or your records, and we do not use your content to train any model.

What we do not promise

Payment, tax, and missed payments

Prices exclude sales tax or VAT where they apply; we add them when we are required to collect them. Card details are handled by Stripe, not by us. If a care plan payment fails we email you and try again. If it is still unpaid 14 days later we may take the site offline. We will never delete your data over a missed payment without telling you first and giving you a way to get a full export.

Refunds

The refund policy is part of this agreement. In brief: a full refund of the migration fee any time before the cutover, no refund after it, and the care plan can be cancelled whenever you like with no refund of part of a month. The one exception: when you move your site to your own Cloudflare account, we refund the unused part of that month.

Ending it

You can stop at any time by telling us. We can end the agreement with 30 days’ notice by email for any reason, or immediately if you break the acceptable-use rule above, do not pay, or deliberately try to damage the service. If we end it for our own convenience, we refund what you have paid for service you will not receive. Either way, we give you a complete export of your content, and we keep it available for 30 days.

Liability, in plain words

We are a small shop. We will do the work carefully and fix our own mistakes, but we cannot carry risk that is larger than the job itself. If something goes wrong and it is our fault, our total responsibility to you is limited to what you have paid us in the 12 months before the problem. We are not responsible for lost profits or lost business, or for damage caused by something outside our control — your registrar, an outage at Cloudflare, or a break-in on your own computer.

Nothing here limits responsibility that the law does not allow us to limit, including fraud, and death or personal injury caused by our negligence.

Keep your own backup of anything you would hate to lose. Do not rely on the preview as a backup service.
